Terms of Use — ClaimHit

1. Acceptance of Terms

By creating an account or using ClaimHit ("the Service"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service. These terms constitute a binding agreement between you and Scintillation Research and Analytics Services Pvt. Ltd. ("we", "us", "ClaimHit").

2. Description of Service

ClaimHit provides AI-powered patent infringement intelligence, including preliminary infringement scans, AI-generated claim charts, automatic patent monitoring, and subject matter expert review services. Results are generated using multiple AI models and are intended for preliminary research purposes only.

3. Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must be at least 18 years old to use the Service.
One account per individual. Team accounts are provided for legitimate professional use by teams and law firms.
We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree to use ClaimHit only for lawful purposes. You must not:

Use the Service to harass, threaten, or intimidate any person or entity
Submit false or misleading patent numbers or information
Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
Use automated scripts or bots to access the Service without our written permission
Resell or redistribute ClaimHit results without our written permission
Use results as a substitute for qualified legal advice in legal proceedings without attorney review
Attempt to gain unauthorised access to any part of the Service or its infrastructure

5. Credits and Payment

Search credits and Hit Chart credits are purchased in advance and consumed when used.
Credits do not expire.
Expert Review services are invoiced by pro forma invoice on delivery — no upfront charge.
Refunds are subject to our Refund Policy.
Prices may change with 30 days notice to registered users.

6. Intellectual Property

Your data: You retain ownership of the patent numbers you search and any information you provide. You grant us a limited licence to process this data to provide the Service.

Our platform: The ClaimHit platform, including its code, design, and AI models, is our proprietary intellectual property. You may not copy, modify, or distribute any part of the platform.

Results: Search results and Hit Charts generated by ClaimHit are provided for your use in connection with your patent portfolio. You may share results with your legal counsel and clients but not redistribute them commercially.

7. Disclaimer of Warranties

ClaimHit is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

Results are accurate, complete, or current
The Service will be uninterrupted or error-free
Results constitute legal advice or will be admissible in legal proceedings without expert review
AI models will identify every infringing product or standard

AI analysis is preliminary research. Always verify results with a qualified patent attorney before taking legal action.

8. Limitation of Liability

To the maximum extent permitted by law, ClaimHit's total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages of any kind.

9. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mohali, Punjab, India.

10. Changes to Terms

We may update these terms from time to time. Material changes will be notified to registered users by email with 30 days notice. Continued use after the effective date constitutes acceptance.
